We are pleased to share a recent appellate victory on behalf of our clients. In Moreno v. Tidwell, No. 04-24-00387-CV (Tex. App.—San Antonio Feb. 25, 2026), the Fourth Court of Appeals wholly affirmed the clients’ trial court victory. The outcome underscores the importance of strong appellate advocacy in disputes involving inherited property.
This case involved real property that our clients received through their parents’ estates. A dispute arose when another party asserted a wide range of claims challenging their rights to the property, including wrongful foreclosure, fraud, breach of contract, and related theories, along with efforts to claim an ownership interest in the property.
At trial, the court entered judgment in favor of our clients, awarding them title and possession and rejecting all claims asserted against them. The opposing party appealed. JW Carter Law was brought in for the appeal, and our focus was clear: demonstrate that the trial court got it right. We emphasized that the evidence supported the judgment because the foreclosure complied with Texas law, and there was no evidence that our clients did anything improper. The Fourth Court of Appeals agreed and affirmed the judgment in full, confirming the clients’ ownership and right to possession of the property.
Disputes involving inherited property can quickly become complex, especially when multiple claims are asserted in an effort to challenge ownership. This case is a reminder that a thoughtful appellate strategy can protect those interests.
